We want you to use X-Plane for fun, for flight proficiency, certain types of flight training, or for testing out your ideas for aircraft designs on the computer, perhaps before building and flying that aircraft for real! We DON'T want you to just blindly count on X-Plane if you are going to be using it for that last purpose, though! Read this carefully, especially the last paragraph, if you are going to use X-Plane to flight-test your designs on the PC before flying them for real.
X-Plane End User Licensee Agreement
Read this agreement before using X-Plane.
By using X-Plane, you agree to all of the terms and conditions of this agreement,
and agree to be bound by this agreement as a complete and exclusive statement of
your agreement with Laminar Research. If you do not agree with any or all of this
agreement, return the software to the seller for a refund.
DEFINITIONS
The following definitions apply to the terms as they appear in this agreement.
"Laminar Research" means Laminar Research Corporation.
"Manual" means the enclosed instruction manual.
"Software" means the computer programs contained in this package,
and all updates to and copies of the programs.
"Product" means the enclosed manual and software.
X-Plane itself may be used for anything you like, including teaching, training, designing
aircraft, with only one exception: X-Plane may only be used for FTD-level flight-training
and above with written permission from Laminar Research.
The Software is owned by Laminar Research and is protected by United States and international copyright laws and international trade provisions. You must treat the Software like any other copyrighted material.
You may not:
=>Make or Distribute copies of the Software, either modified or unmodified.
=>Reverse-engineer, disassemble, decompile, or make any other attempt to discover
the source code of the Software.
Laminar Research warrants the Manual, and disk(s) on which the Software is distributed
to be free from defects in materials and workmanship.
If the Product fails to comply with the warranty set forth above, Laminar Research's entire liability and your exclusive remedy will be replacement of the Product.
IN NO EVENT WILL LAMINAR RESEARCH BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, DIRECT OR INDIRECT, OR OTHER DAMAGES ARISING FROM THE USE OF THE PRODUCT, beyond the replacement of the Product.
LAMINAR RESEARCH DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESSED OR IMPLIED, INCLUDING
BUT NOT LIMITED TO IMPLIED WARRANTIES OR MERCHANT ABILITY AND FITNESS OF THE PRODUCT
FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE PRODUCT.
Laminar Research makes no warranties concerning the accuracy of this product for
flight simulation or any other purposes. Before using the enclosed software to predict
the performance of an untested aircraft design, use the enclosed software to predict
the performance of several similar aircraft whose flight characteristics are already
known, then compare the simulator's predictions to the known performance of those
aircraft. Then make your own decision as to the validity of this manual and the enclosed
software as to their applicability for performance predictions.
